| SYLACAUGANET'S Acceptable Use Policy (AUP) is intended to help protect you, the Internet community, from irresponsible and/or illegal activities. This policy is not intended as an exhaustive list of all prohibited acts, but merely as a guide to acceptable use of our services. SYLACAUGANET will list some specific examples that SYLACAUGANET deems unacceptable. This document provides a general understanding of SYLACAUGANET'S policy of the acceptable uses of SYLACAUGANET'S systems and services. Protection of our customers, the ability to provide quality service to our customers and conformance with existing law are all contributing factors when deciding if a violation has occurred. Attempts to gain access to any computer system or customer's data without consent is prohibited. The person who is issued an SYLACAUGANET Internet account is responsible for each connection made with that account. Only one connection can be made with a single account. One warning will be issued to anyone found logged into our service more than once, after the second violation, the account will be terminated. Unlimited access accounts do not have dedicated service. Therefore, each basic $19.95 account has a six- (6) hour limit. After six- (6) hours of continuous use, the user must disconnect for at least one (1) hour. Failing to log off when your computer is not in use can result in account suspension. This is to help ensure that each customer has equal opportunity to internet access. Any activity, which adversely affects the ability of other users to access SYLACAUGANET'S services, is prohibited. SYLACAUGANET reserves the right, in its sole discretion, to suspend or terminate service to any subscriber at any time, for any reason. If an account is temporarily inactivated as a result of any prohibited activities, nonpayment or any other reason, the account may be subject to reactivation charges and/or deposit requirements determined by SYLACAUGANET. By accepting SYLACAUGANET'S service, you are agreeing to indemnify SYLACAUANET for any claims and expenses, including reasonable attorney's fees, related to your violation to this Agreement. You agree that SYLACAUGANET is not to be held responsible for any actions on your behalf, for any information, including software or other content, placed on the service by you or from your account. Good judgement on the subscriber's behalf is required in order to engage in the use of SYLACAUGANET'S service. You should be aware that you may not use the service to engage illegal activity, violate the network policies of any network accessed through our service or engage in any activity that interferes with other users enjoyment and/or use of SYLACAUGANET'S Internet Service. This policy is concurrent with the Service Agreement you received upon subscribing to SYLACAUGANET Internet Service. This policy covers the following specific topics in the sections below, however this does not limit SYLACAUGANET'S ability to govern the service as deemed necessary by SYLACAUGANET. |
| Privacy |
| SYLACAUGANET does not sell or make generally available your e-mail address or any of your personal information. However, SYLACAUGANET will cooperate with the appropriate legal authorities in investigating claims of illegal activity, including, but not limited to illegal transfer or use of copyrighted material, postings, e-mail containing threats of violence or other illegal activity. SYLACAUGANET reserves the right to access an account's mailbox and other data to resolve system problems. SYLACAUGANET makes no guarantee and assumes no liability for the security of any data on any server, including "secure servers". |
| SYLACAUGANET Internet requires you to follow the guidelines outlined in this policy when using SYLACAUGANET'S e-mail services. Sending large volumes of unsolicited e-mail is referred to as ("mail bombing"). Extremely threatening or harassing e-mail is always prohibited. Sending e-mail of any kind, after being requested to stop, is prohibited. Using an SYLACAUGANET Internet e-mail account to collect responses from unsolicited commercial e-mail is prohibited. "Spamming", or sending the same article to multiple recipients, is strictly prohibited. |
| Usenet Newsgroup Postings |
| SYLACAUGANET reserves the right to terminate any account that may violate this policy. Continued posting of "off-topic" or inappropriate advertisement to a newsgroup is prohibited (Please note that most newsgroups consider any kind of commercial advertisement to be "off-topic"). SYLACAUGANET does not censor the content of any newsgroup. Each user should take appropriate steps to filter their account if they so desire. |
| Internet Relay Chat (IRC) |
| You may not violate any policy of an IRC server when using SYLACAUGANET Internet. If SYLACAUGANET is banned from any server because of an offensive internet user, the offending account will be terminated. |
| Personal and Corporate Web Page |
| With each SYLACAUGANET Internet account a designated amount of web space is included in the monthly fee. Personal accounts have access to 5 Mb of web space and Corporate accounts have access to 20 Mb of web space. A subscriber can purchase more web space, if necessary, for an additional monthly fee. |
| Excessive bandwidth and disk utilization |
| Bandwidth utilization is determined by the total number of bytes transferred from an account's Web and File Transfer Protocol (FTP) space. Disk utilization is determined by the total number of bytes required to store an account's Web, FTP and mail data. If a customer is abusing this service, SYLACAUGANET will contact the subscriber and will be given 48 hours to correct the problem. If the excess use continues, the owner will be requested to upgrade the account's service agreement or to modify the activity creating the excess use. |
| Public Domain Material |
| SYLACAUGANET is not responsible for any software that is downloaded to your system while using our service. You may download public domain programs for your own use or non-commercially redistribute a public domain program. However, SYLACAUGANET does not offer technical support on any programs downloaded to your system, unless furnished or sold to you by SYLACAUGANET. |
| Copyrighted Material |
| Copyrighted material may not be placed on the service without the permission of the owner(s) or person(s) they specifically authorize. You may download copyrighted material to your system for your personal use. Except as expressly provided by copyright law, copying, redistributing or publication must be with the express permission of SYLACAUGANET and the owner(s) or such authorized person(s), if other than SYLACAUGANET. Permission must be specified in the document, on the service or must be obtained directly from SYLACAUGANET and the owner(s) or such authorized person(s), if other that SYLACAUGANET. In any copying, redistribution or publication of copyrighted material, any changes to or deletion of author attribution or copyright notice are prohibited. |
| Editing and Deleting Content |
| SYLACAUGANET reserves the right, in its sole discretion, to edit or delete any information, software or other content appearing on the service, regardless of whether or not it violates the standards for content. |
